Jenna’s practical, resolution-oriented approach helps navigate even the most stressful situations with clarity and care. She understands that empathy and responsiveness go a long way in making a client feel supported.
Jenna Z. Gabay is a partner in the firm’s Commercial Litigation, Trusts & Estates Litigation, and Intellectual Property Practice Groups. She is seasoned litigator who represents clients in state and federal court through all phases of litigation, from inception through appeal.
Jenna represents commercial clients in complex disputes across a broad range of industries, including pharmaceutical companies, animal health companies, financial institutions, wholesalers, distributors, and medical providers, among others.
Her practice includes matters involving breach of contract, restrictive covenants, and trade libel. She has extensive experience with disputes concerning the sale of goods governed by Article 2 of the Uniform Commercial Code (UCC).
In addition, Jenna provides advice and acts as New Jersey counsel in Hatch-Waxman and other patent infringement disputes.
Jenna’s experience also includes trust and estate litigation. She has successfully represented clients in cases challenging the validity of wills due to undue influence, lack of capacity, and defective execution. She has handled contested and non-contested guardianship actions to determine whether an individual requires a guardian and who should serve in that capacity. She has represented beneficiaries and fiduciaries in fiduciary removal actions to determine whether an executor, trustee, or guardian should be removed due to incompetence or misconduct. In addition, she has represented fiduciaries and beneficiaries in contested estate administrations involving disputes over the distribution of a decedent’s assets.
As a complement to her litigation practice, Jenna regularly engages in alternative dispute resolution processes including mediation and arbitration. She has experience with international arbitration before the International Centre for Dispute Resolution (ICDR).
Jenna has been a speaker at various conferences involving Women in Law and the use of AI in Litigation. She currently leads the Hackensack Office’s Women’s Initiative.
During law school, Jenna was a member of The George Washington University Law School International Law Review and the Mock Trial Board. Jenna also interned for Magistrate Judge Joel Schneider of the U.S. District Court for the District of New Jersey.

Representative Matters Include:
- Represented a refrigerant wholesaler in a breach of contract action governed by Article 2 of the UCC
- Represented a bio-pharmaceutical company in a breach of contract action arising out of a co-development relationship with a multinational pharmaceutical company in an international arbitration
- Represented a financial institution against a commercial developer that defaulted on a series of loans
- Represented physician in breach of fiduciary duty and minority oppression action against medical practice
